§ 10-236. Prohibition on the sale or other transfer of animals in certain restricted areas.

  • (a)

    Prohibition. No person shall sell, exchange, barter, trade, lease, rent, give away, display or transfer any animal on any roadside, public right-of-way, parkway, median, park, playground, flea market, commercial or retail parking lot, or property adjacent to such locations, that is generally accessible to the public, regardless of whether such access is authorized or not.

    (b)

    Exception. This section shall not apply to bona fide humane societies, animal welfare groups, animal control agencies or non-profit organizations sponsoring animal adoption events or to sales or other transfers from a personal residence.

    (c)

    Prohibited. Whoever commits a violation of this section shall be guilty of a misdemeanor and shall be punished by a fine of $500.00 or imprisonment for a term not exceeding six months, or both such fine and imprisonment.
