§ 58-53. Conditions for issuance.

  • The public works department shall require that persons seeking permits pursuant to the provisions of this division agree to comply with the following terms as conditions of the issuance of such permits:

    (1)

    All drilling operations associated with the conducting of seismic and/or geophysical testing of the subsurface of any lands shall be performed using good, fresh and potable water free of harmful chemicals, pollutants and/or contaminants.

    (2)

    Permittees shall conduct all seismic and geophysical testing operations at a reasonable and satisfactory distance from adjacent buildings, structures, homes, facilities, wells and properties and at such a depth as to prevent and avoid causing damages to such adjacent structures and properties.

    (3)

    All mud, oil, chemicals, liquids or other foreign substances from tires tracked upon roadways by persons conducting seismic and/or geophysical testing operations shall be removed immediately.

    (4)

    Permittees shall further be required to carry property damage liability insurance with a responsible insurance company authorized to do business in the state, in the following amounts:

    a.

    Comprehensive general liability coverage, including explosion, collapse and underground coverages: $1,000,000.00 combined single limit.

    b.

    Pollution liability coverage: $1,000,000.00 combined single limit.

    c.

    Automobile liability coverage: $1,000,000.00 combined single limit.

    d.

    Umbrella liability coverage: $2,000,000.00 combined single limit.

    Such policies shall provide coverage for all damages caused as a result of their operations pursuant to such permits. Applicants shall submit to the city-parish consolidated government certificates of insurance evidencing such coverage at the time a permit application is submitted under the terms of this division.

    (5)

    Permittees shall fully and adequately repair any and all damages caused to property owned by adjacent landowners as well as damages to roads as a result of their operations pursuant to the permits.

    (6)

    All permittees shall properly cap and/or plug any and all holes caused by their drilling operations, and shall repair and/or restore the surface of each tract or parcel of property immediately upon completion of seismic and geophysical testing to be performed on such property.
