§ 62-108. Drug-free zones.

  • (a)

    Terms defined. As used in this section, certain words are defined as follows:

    (1)

    Drug-free zone shall mean an area inclusive of any property used for school purposes by any school, within 1,000 feet of any such property, and school buses.

    (2)

    School shall mean any public or private elementary, secondary, or vocational-technical school in the parish.

    (3)

    School property shall mean all property used for school purposes, including, but not limited to, school playgrounds.

    (4)

    Park shall mean all parish property used for recreational use in the unincorporated area.

    (b)

    Zones established. Drug-free zones are hereby established in an area inclusive of any property used for school recreational purposes by any school located in whole or in part in the unincorporated areas of the parish, within 1,000 feet of any school property, parish parks, and school buses, all in accordance with R.S. 17:405. The drug-free zones are hereby created and established for the existing public schools, private schools and vocational-technical assistance schools, and parish parks currently located in whole or in part in the unincorporated areas of the parish, the boundaries of which are clearly indicated on a map entitled "Lafayette Parish Drug-Free Zones," which map shall be recorded with the parish clerk of court and made a part of the official records of Lafayette Parish.

    (c)

    Zones marked. Signs or other markings designating the established drug-free zones shall be located in a visible manner on or near each school and park and each school bus, indicating that such area is a drug-free zone, that such zone extends to 1,000 feet of school property, and that a felony violation of the Uniform Controlled Dangerous Substance Law within these zones will subject the offender to severe penalties under law, all in accordance with R.S. 40:981.3.

    (d)

    Assistance of city-parish consolidated government. The Lafayette City-Parish Consolidated Government shall assist the Lafayette Parish School Board in the installation of all necessary signs designating drug-free zones.
