§ 74-82. Precautions required when transporting refuse.

  • Any person collecting, transporting, hauling, or permitting to be collected, transported, or hauled any solid waste, bulky waste, recyclables or other debris to the place of dumping shall take reasonable precautions to prevent the scattering or spilling of the same from the conveyance upon the public streets of LCG, and shall for this purpose, when using any open conveyance, cause the load to be secured with a tarpaulin, canvas, or other covering as needed. Vehicles used for this purpose shall be equipped with tailgates to prevent the spilling of debris during transit. This section shall not apply to trucks properly loaded with heavy waste or debris too heavy to fall or blow off. In addition, any person collecting, transporting, hauling, or permitting to be collected, transported, or hauled any such debris, shall take necessary precaution to comply with applicable federal guidelines, state sanitary code, state transportation and environmental regulations, or other guidelines and regulations to be set down by the public works director.
