§ 78-34. Form of ordinance.

  • The format of ordinances adopted by virtue of the authority established in this article shall be substantially as follows:

    ORDINANCE NO. O-_______

    AN ORDINANCE DECLARING THE CONSTRUCTION OF ___________ A PUBLIC NECESSITY AND AUTHORIZING THE ACQUISITION OF THE NECESSARY RIGHTS-OF-WAY AND OTHER PROPERTY RIGHTS REQUISITE TO THE CONSTRUCTION OF SAID PROJECT EITHER ON AN AMICABLE BASIS OR THROUGH THE USE OF THE EXPROPRIATION PROCESS, IF NECESSARY.

    BE IT ORDAINED by the Lafayette City-Parish Consolidated Council:

    SECTION 1: This Council hereby declares ___________ to be a public necessity.

    SECTION 2: The public purpose to be served by the construction of said project is: _____

    SECTION 3: The project termini are as follows: _____

    SECTION 4: A copy of the proposed project plan indicating the established project centerline is on file in the office of ___________, and is made a part hereof by reference; and said centerline is hereby approved and accepted by this Council as proposed.

    SECTION 5: Accordingly, the City-Parish President is authorized to acquire such rights-of-way, servitudes, construction easements, or other property rights as are found to be necessary under good engineering standards to provide for the construction of said project; and he is authorized to do so on an amicable basis or by the proper use of the power of expropriation granted under applicable state law. In pursuing said right-of-way acquisitions, he is authorized to acquire said rights-of-way and to settle the matters thus presented, on such terms and conditions as he shall deem proper and in the best interest of the city-parish consolidated government.

    SECTION 6: All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.
