§ 82-801. Authorization to license certain organizations; exemption.

  • (a)

    The director of administration of the city, or his designee, is hereby authorized to license or permit any charitable organization, as that term is defined in R.S. 33:4861.2(1)(a), as amended from time to time, and such other organizations, as are defined in R.S. 33:4861.4(C), as amended from time to time, to hold and operate the following specific games of chance:

    (1)

    The game or games of chance commonly known as raffles played by drawing for prizes or the allotment of prizes by chance, by the selling of shares, tickets or rights to participate in such game or games, and by conducting the game or games accordingly;

    (2)

    The game or games of chance commonly known as bingo or keno played for prizes with cards bearing numbers or other designations, five or more in one line, the holder covering numbers, as objects, similarly numbered, are drawn from a receptacle, and the game or games being won by the person who first covers a previously designated arrangement of numbers on such a card; and

    (3)

    The game or games of chance commonly known as electronic or video bingo games played in accordance with the provisions of and prescribed by R.S. 33:4861.17, as amended from time to time.

    Any such organization so licensed may sell shares, tickets or rights to participate in such games and may conduct the games accordingly when the entire net proceeds of such games of chance are to be devoted to educational, charitable, patriotic, religious or public spirited uses, and when so licensed, may hold, operate and conduct such games of chance exclusively by its active members pursuant to this article, only on or in premises owned and occupied or leased by the licensee, unless a waiver is granted as hereinafter provided. Any such organization so licensed may sell shares, tickets or rights to participate in such game or games of chance pursuant to rules and regulations for the supervision and conduct thereof, as prescribed by the director of administration, or his designee, from time to time. Any person or persons may participate in and play such games of chance conducted under any such license.

    (b)

    A bona fide senior citizens recreation club, upon application to the director of administration or his designee shall be exempt from the licensing and reporting procedure enumerated in this article. A "senior citizen recreation club" for the purposes of this article shall be defined as an organization, which is sanctioned by the local council on aging, composed of a group of persons 60 years of age or older, whose only function is to provide amusement and diversion for its members.
