§ 90-53. Qualifications.

  • (a)

    Applicants for permits issued under the provisions of this division shall meet the following qualifications and conditions:

    (1)

    An applicant who is a natural person must be a person 21 years of age or older.

    (2)

    The applicant must be the owner of the premises, or have a bona fide written lease for the duration of the permit. In cases where the applicant holds a bona fide written lease, the name and current address of the lessor shall be shown on the application with the department.

    (3)

    The applicant shall not have been convicted of a felony theft under the laws of the United States, the state, or any other state or country.

    (4)

    The applicant shall not have been convicted in the United States, the state, or any other state or country, or in any political subdivision thereof, of any crime involving theft, or the receiving of, possession of or dealing in stolen property, whether a misdemeanor or felony.

    (5)

    The applicant shall not have had a license or permit to buy, sell, acquire, dispose of or deal in secondhand property issued by the United States or any other country, the state or any other state, or any political subdivision authorized to issue licenses or permits, revoked within five years prior to the application.

    (6)

    The applicant shall not be the spouse of a person whose application has been denied or whose permit has been revoked, unless judicially separated or divorced.

    (7)

    An applicant who is a natural person must be a citizen of the United States and of the state and a resident of the state continuously for a period of not less than two years preceding the date of filing of the application.

    (8)

    The applicant shall have no occupational license tax due the city-parish consolidated government.

    (b)

    If the application is submitted by a partnership or anyone in partnership or financed by another, all members of the partnership or all the persons in any way financially involved with the business also shall possess the qualifications of an applicant. The applicant shall state the full names of all partners and persons financially involved and furnish their proper addresses. Each shall furnish his affidavit showing his qualifications, as required of an applicant.

    (c)

    If the application is submitted by a corporation, all officers and directors and all stockholders owning in the aggregate of ten percent or more of the stock, and the persons who manage the business, shall possess the qualifications required of an applicant, to be shown by affidavit of each accompanying the application. The requirements of citizenship and residence do not apply to officers, directors or stockholders of a corporation making application. The corporation shall be either organized under the laws of the state or qualified to do business within the state.

    (d)

    If the applicant's business is to be conducted wholly or partly by one or more managers, those persons designated as managers shall also possess the qualifications required of the applicant to be shown by affidavit of each accompanying the application.

    (e)

    If the applicant, or any other person required to have the same qualifications, does not possess the required qualifications, the department shall not issue the permit.
