§ 94-11. Cutting or removing electric wires or fiber cables.

  • (a)

    Whenever it becomes necessary to remove or cut any of the electric wires or fiber cables belonging to the system, notice must be given to the director by the person desiring such cutting or disconnection, stating when and where the cutting or disconnection is required. A sum sufficient to cover the cutting or disconnection, as estimated by the director, shall be deposited with the system, and such cutting, disconnecting or removing of wires shall be done by or under the direction of the director, and the cost of labor and material shall be charged to the person desiring the work to be done and paid from the money deposited with the system, and any surplus of the deposit shall be returned upon a voucher duly signed by the director.

    (b)

    Failure to provide the director with the required notification prior to the cutting and/or disconnecting of electric wires belonging to the system will result in a penalty of $50.00 being assessed against the person responsible for the cutting or disconnection. If, in the judgment of the director, an unsafe condition results from the cutting and/or disconnection of the system's electric wires or fiber cables, which is potentially harmful to a person's well-being, life and/or property, the person responsible will be assessed a penalty of $100.00. Any penalties shall be in addition to the cost of labor and material as referred to in subsection (a) of this section.
