§ 98-56. Registration.

  • (a)

    An individual may submit an application to a transportation network company for registration as a transportation network operator.

    (b)

    A transportation network company shall approve or deny an application submitted under subsection (a) of this section within 60 days after the application has been submitted.

    (c)

    Before approving an application submitted under subsection (a) of this section, a transportation network company shall:

    (1)

    Conduct, or have a third party conduct, a local and national criminal background check for each applicant that shall include:

    a.

    Multi-State/Juris Criminal Records Locator or other similar commercial nationwide database with validation (primary source search); and

    b.

    Federal Bureau of Investigation National Sex Offender Registry database or the National Sex Offender Public Website.

    (2)

    Conduct, or have a third party conduct, a driving record check for each applicant.

    (d)

    A transportation network company shall not approve an application submitted under subsection (a) of this section and shall disqualify an applicant who:

    (1)

    As shown in the local and national criminal background check required under paragraph (c)(1) of this section, has been convicted within the past seven years of, has completed imprisonment, parole or probation within the past two years for, or is presently charged with:

    a.

    An offense under La. R.S. Title 14, Chapter 1, Part II, "Offenses Against the Person" (La. R.S. 14:29, et. seq.).

    b.

    An offense under La. R.S. Title 14, Chapter 1, Part III, "Offenses Against Property" (La. R.S. 14:51, et. seq.).

    c.

    An offense under La. R.S. Title 14, Chapter 1, Part V, "Offenses Affecting the Public Morals" (La. R.S. 14:80, et. seq.).

    d.

    An offense under La. R.S. Title 14, Chapter 1, Part VI, Subpart A, Paragraph I "Illegal Carrying and Discharge of Weapons" (La. R.S. 14:94, et. seq.).

    e.

    An offense under the law of any state, under federal law, or under the law of any other jurisdiction, which involved conduct that would constitute an offense described in subparagraphs a. through d. of this paragraph if committed in the State of Louisiana.

    (2)

    Is a match in the Federal Bureau of Investigation's National Sex Offender Registry database or in a state, territorial, or tribal sex offender registry;

    (3)

    As shown in the driving record check required under paragraph (c)(2) of this section, has been convicted within the past seven years of, has completed imprisonment, parole or probation within the past two years for, or is presently charged with:

    a.

    An offense under La. R.S. Title 14, Chapter 1, Part VI, Subpart A, Paragraph 3 "Driving Offenses" (La. R.S. 14:98, et. seq.).

    b.

    Flight from an officer under La. R.S. 14:108.1.

    c.

    Operating a vehicle while license is suspended, revoked or cancelled under La. R.S. 32:415.

    d.

    An offense under the law of any state, under federal law, or under the law of any other jurisdiction, which involved conduct that would constitute an offense described in subparagraphs a. through c. of this paragraph if committed in the State of Louisiana.

    (e)

    A transportation network company shall conduct a criminal background check, driving record check and National Sex Offender Registry database check for each transportation network operator every 12 months after the transportation network operator's application is approved. If the transportation network company becomes aware that an operator has been charged with any of the offenses set forth in subsection (d)(1) or (d)(3) of this section, the transportation network company shall suspend the transportation network operator pending the final disposition of the charges, and terminate the transportation network operator upon conviction thereof. A transportation network company shall terminate a transportation network operator found to be a match in the Federal Bureau of Investigation's National Sex Offender Registry database or in a state, territorial, or tribal sex offender registry.

    (f)

    A transportation network company shall pay to LCG an annual fee of $5,000.00.
