§ 98-132. Requirements.

  • (a)

    It shall be unlawful for any wrecker drivers to operate wreckers or towing vehicles in the city and/or unincorporated areas of the parish who do not possess a current and properly classified motor vehicle license and/or chauffeur's license issued by the state as required by R.S. 32:401 et seq., covering and authorizing said driver to operate the particular type of towing or wrecker vehicle being used and/or furnished by such driver.

    (b)

    It shall be unlawful for any wrecker drivers and/or wrecker operators to operate wreckers or towing vehicles and/or wrecker and towing businesses in the city and/or the unincorporated areas of the parish who:

    (1)

    Have ever been convicted of a felony as defined in R.S. 14:2(4).

    (2)

    Have been convicted within the previous ten years of a violation of any of the following provisions of:

    a.

    R.S. 32:521, pertaining to stored motor vehicles;

    b.

    R.S. 32:701 et seq., known as the Louisiana certificate of title law;

    c.

    R.S. 14:67, including theft of motor vehicles, component parts and/or accessories thereof;

    d.

    R.S. 14:98 et seq., regarding operating a vehicle while intoxicated; or

    e.

    R.S. 14:98.1 et seq., operating a vehicle while under the influence of marijuana, morphine, or cocaine.

    (c)

    Wrecker operators shall register individually with each law enforcement agency in order to be placed on their rotation call out lists for emergency and/or heavy duty nonconsensual tows and to be eligible to make private property nonconsensual tows in the parish. When registering, wrecker operators shall be required to produce evidence that their tow trucks have been properly licensed and inspected as required under the provisions of title 55, part I, chapter 19 of the Louisiana Administrative Code. Operators shall further be required to provide lists identifying all wrecker drivers employed by them who will operate tow trucks on their behalf, and to produce evidence that all of their wrecker drivers are properly licensed as required under subsection (a) of this section. Wrecker operators and wrecker drivers shall also be subject to background checks in order to verify compliance with subsection (b) of this section before being placed on law enforcement rotation call out lists. Wrecker operators shall not be placed on law enforcement rotation call out lists until they have fulfilled all insurance requirements set forth in section 98-133 of this division.
