§ 62-49. Loitering to solicit prostitution.

  • (a)

    It shall be unlawful for any person to loiter in or near any street or public place in a manner and under circumstances manifesting the purpose of inducing, enticing, soliciting or procuring another to commit an act of prostitution. The circumstances which may be considered in determining whether such purpose is manifested include, but are not limited to, the following:

    (1)

    The person repeatedly beckons to passerby.

    (2)

    The person repeatedly stops or attempts to stop passerby.

    (3)

    The person repeatedly engages passerby in conversation.

    (4)

    The person repeatedly stops or attempts to stop motor vehicles or motor vehicle operators by hailing them or gesturing to them.

    (b)

    The term "prostitution," as used in this section, means the practice by a person of indiscriminate sexual intercourse with others for compensation or the solicitation by one person of another with the intent to engage in indiscriminate sexual intercourse with the latter for compensation.
